Terms of Service

Welcome to iExPander! These Terms of Service ("Terms") govern your use of the iExPander AI-powered image editing and generation platform at https://imageexpander.org/ (the "Service"), operated by MXC LLC. By accessing or using our Service, you agree to these Terms and our Acceptable Use Policy. Please read them carefully.

1. Service Overview

iExPander provides AI-powered tools for expanding, enhancing, editing, and generating images and related media for lawful creative, commercial, and educational purposes. We do not offer adult content products, and Face Swap / deepfake face-replacement features have been discontinued.

2. User Responsibilities

  • You must use iExPander in compliance with all applicable laws and these Terms.
  • You are responsible for the content you upload, generate, or share using our platform.
  • You must not use iExPander to create, share, or distribute content that is illegal, harmful, infringing, misleading, or violates the rights of others.
  • You agree not to attempt to reverse engineer, disrupt, or abuse the service or its underlying technology.

3. Prohibited Content (Adult, NCII, Deepfake, Minors)

Without limitation, you may not upload, prompt, generate, distribute, or sell:

  • Pornographic or adult sexual content, including explicit sexual content, nude genitalia for sexual purposes, or sexually suggestive generation intended as adult entertainment.
  • Non-consensual intimate imagery (NCII), including any intimate, nude, or sexual depiction of a real person created or edited without that person's clear consent.
  • Deepfakes and unauthorized likeness use, including generating or editing content that impersonates a real person, swaps a real person's face, or otherwise uses a real person's likeness, voice, or identity without authorization, especially for deceptive, harmful, political, or sexual purposes.
  • Content involving minors in any sexual, pornographic, exploitative, abusive, or otherwise inappropriate context. We have zero tolerance for child sexual exploitation and abuse material (real or synthetic).
  • Any other content prohibited by card network rules, Stripe's Acceptable Use Policy, or applicable law.

We use automated prompt and image moderation and may refuse, block, delete, refund, suspend, or ban accounts that violate these rules. Repeated violations may result in permanent termination.

4. Intellectual Property

  • All intellectual property rights in the iExPander platform, including its AI models, algorithms, and branding, are owned by iExPander or its licensors.
  • You retain ownership of your original input content (images, prompts). Generated images are licensed to you for personal or commercial use as permitted below, subject to these Terms and the Acceptable Use Policy.

5. License & Usage

  • iExPander grants you a limited, non-exclusive, non-transferable license to use the platform and generated images for lawful personal, educational, or commercial purposes, subject to these Terms.
  • You may not resell, sublicense, or redistribute the platform or its outputs except as expressly permitted.

6. Content Guidelines

  • Do not upload or generate content that is unlawful, offensive, or infringes on intellectual property rights.
  • Do not use iExPander to create content that promotes hate, violence, discrimination, or misinformation.
  • You are solely responsible for ensuring you have the rights and consents to use any input content and for the use of generated images in your projects.

7. Enforcement & Monitoring

  • We screen prompts and uploaded images with automated moderation systems before or during processing.
  • Blocked jobs are marked failed and may not consume or may refund credits depending on timing.
  • We may review logs, investigate abuse reports, and cooperate with payment processors and law enforcement where required.

8. Service Availability & Changes

  • We strive to provide reliable service, but availability may be affected by maintenance, updates, or technical issues.
  • iExPander may update, modify, or discontinue features at any time without prior notice.
  • We reserve the right to suspend or terminate access for violations of these Terms or misuse of the service.

9. Plans, Credits & "Unlimited"

Paid plans, credits, and any "Unlimited" offering are described on our pricing page and may change. Credits, included models, resolution or duration caps, and plan perks are not a guarantee of speed, wait time, concurrency, or uninterrupted availability.

"Unlimited" means access to included basic and enhanced models subject to these Terms and fair-use operation of a shared processing pool. It does not mean unrestricted, instantaneous, or priority generation. We may queue, throttle, rate-limit, or deprioritize Unlimited jobs based on your usage frequency and overall demand. Generations that consume credits (including SOTA models and jobs above included resolution or duration caps) may be processed with higher priority.

SOTA models and certain outputs still require credits on an Unlimited plan. The current SOTA list and caps (including higher resolutions and longer videos) are shown on the pricing page and in the product UI and may be updated from time to time.

MXC LLC / iExPander reserves the sole right to interpret, clarify, and update Unlimited eligibility, included models, fair-use thresholds, queue priority, credit deductions, refunds for failed jobs, and related plan rules. Abuse, automation intended to exhaust shared capacity, or circumvention of limits may result in throttling, suspension, or termination.

10. Disclaimers

  • iExPander is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not guarantee uninterrupted service, error-free operation, or perfect generation results.
  • We are not responsible for any loss, damage, or claims arising from your use of the platform or generated content.

11. Limitation of Liability

  • To the fullest extent permitted by law, iExPander and its affiliates are not liable for any indirect, incidental, special, or consequential damages, or for loss of data, profits, or business arising from your use of the service.
  • Our total liability for any claim related to the service will not exceed the amount you paid (if any) for using iExPander.

12. Indemnification

You agree to indemnify and hold harmless MXC LLC / iExPander and its affiliates from any claims, damages, or expenses arising from your use of the service, violation of these Terms, or infringement of any rights.

13. Modifications to Terms

We may update these Terms from time to time. Significant changes will be posted on this page with a new effective date. Continued use of iExPander after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes will be resolved in the courts of the United States, and you agree to submit to their jurisdiction.
